An informal discussion on patent—the Fiftieth Energy Forum

On February 23 at half past seven in the evening, Academic Department organized the fiftieth energy forum in A221, Hemu building. They invited Zhang Binbin as our teacher, in order to exchange knowledge about patents and technology innovation with us. The content of his lecture is: what is the patent, the patent examination and approval and implementation, the introduction to “right-claiming document”, etc.


First, he pointed out that China has the biggest quantity of patent application, but much lower than the U.S. and Europe as to patent conversion rate so we are not a power of patent at all. Since patent is a subordinate conception below intellectual property right, Zhang showed us how we assort intellectual property right in China, and the smile curve was shown to illustrate that technological patent and brand service take the biggest part of profit.

Patent is an abbreviation for patent right. Proprietary, territoriality and practicality are three main features of patent. Government give aegis to three kinds of patent, including inventions, appearance design and utility model, and the time limits of the protection are also different. Government also announced that they won’t admit new kinds of animals and plants as well as inventions which run counter to law and science.

So what is the process of patent application review and approval? Zhang Binbin introduced to us that different types of patent processes are not the same, if we want to gain invention patents, there are steps from the beginning of the application to the preliminary review, publication, substantive review, the final choice is to reject or grant patent right. Especially after substantive review there will be another review or litigation procedures. The invention which can be granted patent right may require novelty, creativity and practicality.

After applying for a patent, the patent holder has the right to mark, to use and to dispose. The implementation of the patent can be implemented on their own, but also allows others to implement. The teacher pointed out that in a science research, there are many patent-related work, such as the collection and analysis of patent information, determination of the direction of research, the preparation for patent application. However, the protection of innovation and research results not only protect patent.

Zhang analyzed the patent application, and he said that the core of the patent application is the right-claiming document, which plays the central role as a legal document to determine the scope of patent protection. On the basis of the manual, it emphasizes the scope of right that the applicants want to cover. From the perspective of the process of writing the patent application documents, the teacher made a logical analysis, including the excavation of the patent and so on. In the process of writing documents, the applicant needs to broaden the idea. At the same time, the teacher also clarified several issues of patent applications, as well as the sharing of patent applications and patent technology development strategy. Taking BYD and graphene as examples, the teacher analyzes the structure of a patent application, and he also showed the patent layout of OPPO flash charging and WeChat.

After the end of the report, students actively put forward their own questions. Zhang Binbin answered for the students one by one, and give the forum a successful conclusion.
